Reg 256 - Statement of Facts

The Reg. 256 is a DMV form used for multiple situations listed below;

  1. Use Tax Exemption 
  • Family transfer including the following; parent, child, grandparent, grandchild, spouse, domestic partner or siblings (if both are minors related by blood or adoption).
  •  Addition or deletion on Title Certificate
  • Gift
  • Court order
  • Inheritance.

When and what fields to complete?

Depending on your situation you will need to check one of the above options provided, and add the current market value of the vehicle.

If, this transaction includes a Family transfer, you will need to complete section B (Statement for Smog Exemption), Section G (Statement of Facts) and Section H (Applicant's Signature).  

*Please refer below to Number 2 and 6 on how to complete these fields.

 

   2. Smog Exemptions Statement 

  • Valid reason smog request is overridden or has been completed within last 90 days.

When and what fields to complete?

You will need to complete this field when there is a family transfer or is a gift that has already past smog within the last 90 days.

Select from the following options:

If it is a Family Transfer you will need to check the box that states;

- It is being transferred from / between:

You will need to select the box that states the option that best fits your situation:

- In this case, select; The parent, grandparent, child, grandchild, brother, sister, spouse etc.

In a Family transfer case, you will also need to complete section A (Statement for use Tax Exemption), Section G (Statement of Facts) and  Section H (Applicant's Signature).

 

If it is a Gift between friends or not intermediate family members and DMV needs proof of Smog you will need to select the box that states;

The last smog certification was obtained within the last 90 days, and you will need to provide a copy of the  physical passed smog certificate.

If, this transaction is a Gift, you will need to complete section A (Statement of Use For Tax Exemption) and Section H (Applicant's Signature).

  *Please refer to Number 1 on how to complete these fields.

 

  3.Transfer Only or Title Only Statement 

  • When a non-working vehicle that is not registered in DMV system (Planned Non Operation - Vehicle) and needs either a transfer only (Selling vehicle to new owner) or Title only (Title Certificate).

When and what fields to complete?

If the new owner Transferring a Planned-Non Operating Vehicle and will not register or renew the vehicle, or the owner is requesting for a Title only, you will need to select the box that indicates the request.

Select either:

- Transfer only

or

- Title only

You will also need to fill out  Section H (Applicants Signature).

 

  4. Window Decal for Wheelchair Lift or Wheelchair Carrier 

Vehicle must have a wheelchair lift or caroler that obstructs the view of the rear license plate.

To request a decal you must either:

  • have a disabled person placard,
  • transport person(s) with a disabled person placard,
  • have a vehicle with disabled person license plates, or
  • have a vehicle with disabled veteran license plates.

What fields to complete?

To apply for a decal;

  • your request for the window decal,
  • your placard number or disabled person/disabled veteran license plate number,
  • the license plate number of the vehicle that will have the decal affixed to it,
  • the vehicle identification number,
  • year and make of the vehicle,
  • mailing address, name, and signature.
  • The decals are available at no cost.

You will also need to complete Section H (Applicants Signature).

NOTE:

Mail the REG 256 to:

Department of Motor Vehicles
Special Processing Unit
P.O. Box 932345 Mail Station D238
Sacramento, CA 94232-3450

Do not submit your application to a field office. The decal will be mailed to you within six to eight weeks.

 

 

 

  5. Vehicle Body Change Statement (Ownership Certificate Required) 

Types of Changes that need to be reported:

  • Weight
  • Gas Type (Ex. Diesel to Electric)
  • Body Type
  • Addition or deletion of Axles

What fields to complete?

- Mark the current market value of the vehicle or vessel.

- List cost of change and the date in which changes were made.

Check the box that indicates the correct change on your vehicle.

You will also need to complete Section H (Applicants Signature).

 

  6. Name Statement (Ownership Certificate Required) 

Use of this section includes the following changes of your name:

  • Is not your true full name.
  • Is misspelled.
  • Changes (for example, as a result of marriage or divorce).
  • Is legally Changed.

NOTE: If your last name is hyphenated or is multiple words, the last name will appear as one word on the California Certificate of Title and registration card. This is not an error and does not require correction.

What fields to complete?

- When the name that appears on Title is not your true full name;

Check the box with, "I _current name on title   and    correct full name   are one and the same person."

- When your name is misspelled;

Check the box with, "My name is misspelled. Pleas correct to: __correct full name   ."

- When your name changes (as a result of marriage / divorce) or is legally changes;

Check the box with, "I am changing my name from __current full name  to  correct full name."

You will also need to fill out Section H (Applicants Signature).

 

  7. Statement of Facts 

  • Owner stating that all information provided is true and correct.

Ex. - (Family transfer) My father gave me his son this vehicle.

What fields to complete?

You will only need to complete this section if you are transferring a vehicle as a family gift (family described under DMV guidelines) or a gift between friends. Other sections that will need to be filled out are; sections A (Statement For Use Tax Exemptions), section B (Statement for Smog Exemption - if a gift between friend refer to number 2 above may not need to fill out), and section H (Applicant's Signature).
